Tradehack Pty Ltd (Tradehack) reserves the right to update and change the Terms of Service periodically. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.
You agree to use the Service at your own risk and acknowledge that any breach of the terms below will result in the termination of your Account.
You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process.
Logins are to be used by one person only. Sharing of single logins between multiple persons is not permitted. Individual logins can be created for additional users, under the same account, with legal full name, valid email address and any other information requested needing to be supplied.
Account and password security is your responsibility. Tradehack will not be held liable for any loss or damage as a result of your failure to keep this information secure.
The primary account holder is responsible for all content posted/activity occurring under its account. The software is to be used solely for its intended purpose (backflow testing). Inappropriate and/or unauthorised use of the software will result in termination of your account.
All fees are in Australian Dollars (AUD) and are inclusive of GST (Goods and Services Tax). All charges to your credit card will show on your statement as ‘Tradehack PTY LTD’.
No credit card details are required for the ‘One Month Trial Period’.
All ‘Bundle of 10’ purchases will require a valid credit card at the time of purchase and are valid for a period of 12 months or until the last test has been used. Automatic recharge for additional ‘Bundle of 10’ will occur either at the end of the 12 month period or upon starting a new test after the 10th test has been used. This will continue until the user either cancels the account or upgrades to a ‘Subscription Account’ model.
All ‘Subscription Accounts’ will require a valid credit card and are billed on the same date (anniversary) each month. Charges billed will be according to usage within the billing period (i.e. number of valves tested/month) as per the Subscription model. Automatic recharge will occur on the anniversary date each month until the Primary User cancels the subscription.
There are no refunds for partial months if the service is cancelled.
Cancellation of your account may cause the loss of data/content of your account. All data remains the property of Tradehack PTY LTD.
Cancellation of an account is the sole responsibility of the Primary Account user.
Your account can only be cancelled via the app. See the app software (‘Settings’,‘Billing’) for subscription cancellation.
All access to data will be removed upon cancellation of your subscription. This includes all data created by both the Primary Account and any Users created under the Primary Account.
All subscription cancellations made midway through the billing period will still require full payment at the end of the billing period, as per the pricing model (i.e. number of valves tested/month). Full access to the system will still be available until the end of the billing period.
Tradehack retains the right, at its sole discretion, to suspend or terminate your account. It also retains the right to refuse any and all current or future use of the Service, including any other Tradehack service/s, for any reason at any time.
Termination of your Service will include the deactivation and/or deletion of your account. This will include any user accounts created under your primary account and the content contained therein.
Tradehack reserves the right to refuse service to anyone for any reason at any time.
Tradehack reserves the right at any time and from time to time to temporarily or permanently, modify, or discontinue, the Service (or any part thereof) with notice.
Prices of all Services are subject to change upon 30 days’ notice from us. Such notice may be provided at any time by email notification and posting of said changes to Tradehack website.
Tradehack shall not be liable to any parties for any price change, modification, suspension of account or discontinuance of Service.
Tradehack retain, in their sole discretion, the right to remove or refuse any Content that is available via the Service.
The appearance and composition of the Service is copyright to Tradehack PTY LTD. Duplication, copying, or reusing of any portion of the HTML/CSS, JavaScript, or visual design elements or concepts, without express written permission from Tradehack, is not permitted.
You are aware, and agree, that the service is provided on an "as is" and "as available" basis and therefore Tradehack shall not be held liable in relation to its usability and availability.
Technical support is provided via email only, and only to paying and ‘trial’ account holders.
You understand that Tradehack uses third party vendors and hosting partners to provide the necessary technology required to run the Service including, but not limited to, hardware, software, networking, and storage.
You agree not to copy, sell, resell, reproduce, duplicate, or exploit any portion of the Service, access to the Service or use of the Service without the express written permission by Tradehack.
You must not adapt, modify, or hack the Service. You must not modify another website so as to falsely insinuate that it is associated with the Service of Tradehack.
Tradehack, without any obligation to, may remove Content and Accounts containing Content that we deem, in our sole discretion, is offensive, threatening, libellous, unlawful, defamatory, obscene, pornographic, or otherwise objectionable or violates any party's intellectual property or these Terms of Service.
Written, verbal, physical, or other abuse (including threats of abuse or retribution) of any Tradehack customer, employee, member, or officer will not be tolerated and will result in the immediate termination of the offenders account.
You understand that your Content, as part of the processing and transmission of the Service, may be transmitted unencrypted over various networks and require changes to coincide with the technical requirements of the connecting systems and/or devices.
The posting, uploading, hosting, or transmission of unsolicited email, SMSs, or "spam" messages is not permitted.
The transmission of any worms or viruses or any code of a destructive nature is not permitted.
We reserve the right, should you significantly exceed the average bandwidth usage of other Tradehack customers (as solely determined by Tradehack), to immediately suspend/disable your account until you can reduce your bandwidth consumption.
Tradehack does not warrant the following:
(i) the service will meet your specific needs
(ii) the service will be timely, secure, uninterrupted, or free from error
(iii) the results that may be obtained from the use of the service will be precise or trustworthy
(iv) the quality of any information, services, products, or other material obtained or purchased by you through the service will meet your expectations, and
(v) any errors in the Service will be corrected.
You clearly understand and concur that Tradehack will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for intangible losses including, but not limited to, loss of profits, goodwill, use or data (even if Tradehack has been advised of the possibility of such damages), resulting from:
(i) the use of the service
(ii) the inability to use the service;
(iii) alteration of, or unauthorized access to, your transmissions or data;
(iv) declarations or behaviour of any third party on the service;
(v) the cost of provision of alternate goods and services resulting from any data, information, goods, or services purchased or obtained or transactions entered into or messages received through or from the service;
(vi) or any other matter relating to the service.
The Terms of Service comprises the entire agreement between yourself and Tradehack and regulate your use of the Service, superseding any prior agreements between yourself and Tradehack (including, but not limited to, any prior versions of the Terms of Service). The failure of Tradehack to exercise or enforce any right or provision of the Terms of Service shall not be deemed as a waiver of such right or provision.
Monthly Subscriptions and Pay As You Go Accounts are defined as:
performing less than 1000 Backflow or TMV tests per annum; and/or
not required to perform any Water Filter, Eye Wash or Aux/Asset Register tests/devices; and/or
requring 5 Account logins (i.e. staff members) or less; and/or
holding 100 or less Backflow and/or TMV devices per client; and/or
managing a majority of external clients only, i.e. Your company manages the devices of the device owners; and/or
requiring no initial on-boarding by a Tradehack account manager; and/or
requiring email only support totally no more than 15 minutes per month.
Corporate accounts are defined as:
managing a majority of internal assets only. i.e the account holder and device have the same owner; and/or
manages any Backflow, TMV, Water Filter, Eye Wash and Aux/Asset Register Devices in any combination; and/or
requiring phone and email support of more than 15 minutes per month; and/or
requiring a custom on-boarding process by a Tradehack account manager.
The guideline above are factors used to determine your account type. If Tradehack has deemed an account holder to be classified as a corporate account, Tradehack has the right to enforce an exclusive corporate account between the account holder and the Client.
A corporate account holder must negotiate a corporate rate pricing structure with Tradehack per each corporate account.
